1. What is Figlet?
Welcome to Figlet. Please read these terms carefully. They govern your use of our website, products, services, and applications at figlet.empathi.com (the "Services"). If you have questions, contact us at figs@empathi.com.
These Terms of Use (the "Terms") are a binding contract between you and Empathi ("Empathi," "we," and "us"). You must agree to and accept all of the Terms, or you do not have the right to use the Services. Your use of the Services in any way means that you agree to all of the Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document as well as those in the Empathi Privacy Policy.
2. Our Services
Figlet is an AI-powered relationship coaching and psychoeducational self-help tool designed by Figs O'Sullivan, LMFT. Figlet helps individuals and couples understand their relationship patterns, attachment dynamics, and emotional responses. The Services do not include the provision of therapy, medical care, mental health services, counseling, diagnosis, treatment, or other professional clinical services.
Figlet is relationship coaching and psychoeducation. Figlet is not therapy.
USE OF THE SERVICES IS NOT FOR EMERGENCIES. IF YOU THINK YOU HAVE A MEDICAL OR MENTAL HEALTH EMERGENCY, CALL 911 OR GO TO THE NEAREST OPEN CLINIC OR EMERGENCY ROOM.
IF YOU ARE CONSIDERING OR COMMITTING SUICIDE OR FEEL THAT YOU ARE A DANGER TO YOURSELF OR TO OTHERS, YOU MUST DISCONTINUE USE OF THE SERVICES IMMEDIATELY AND CALL 911, THE 988 SUICIDE AND CRISIS LIFELINE (CALL OR TEXT 988), OR NOTIFY APPROPRIATE POLICE OR EMERGENCY MEDICAL PERSONNEL.

3. Who Should Not Use Figlet
Figlet is designed for adults (18 years of age or older) who want to better understand their relationship dynamics. Figlet is not appropriate for you if:
- You are currently in a mental health crisis.
- You are unable to regulate your emotional responses while discussing your relationship.
- You are in an active domestic violence situation where discussing your relationship could put you at risk of harm.
- You are under 18 years of age.
- You are seeking a diagnosis or treatment for a mental health condition.
- Your mental health needs exceed the scope of guided self-help and relationship coaching.
If any of the above apply to you, we strongly encourage you to seek support from a licensed psychotherapist or qualified healthcare professional in the state or jurisdiction where you live. If your needs appear beyond the scope of relationship coaching, you will be advised to seek alternative services from a qualified mental health professional.
We do not knowingly collect or solicit personally identifiable information from children under 18. If you are under 18, please do not attempt to use the Services or send any personal information to us. If we learn we have collected personal information from someone under 18, we will delete that information as quickly as possible.
4. Figlet Does Not Provide Medical or Therapeutic Advice
While the Services may provide access to information about relationships, attachment, and emotional patterns, the Services cannot and are not intended to provide medical advice, therapeutic advice, mental health treatment, or clinical care. The Services provide psychoeducational information and relationship coaching to help you understand yourself and your relationship. All such information is not intended to replace or complement any professional medical or therapeutic consultation.
The provision of content through the Services does not create a therapist-client relationship, a medical professional-patient relationship, or any other clinical relationship, and does not constitute an opinion, medical advice, therapeutic advice, diagnosis, or treatment of any particular condition.
NO LICENSED THERAPIST-CLIENT RELATIONSHIP, MEDICAL PROFESSIONAL-PATIENT RELATIONSHIP, OR OTHER CLINICAL RELATIONSHIP IS CREATED BY USING INFORMATION AND/OR SERVICES PROVIDED BY OR THROUGH THE USE OF THE SERVICES OR THROUGH ANY OTHER COMMUNICATIONS FROM EMPATHI OR FIGS O'SULLIVAN.
THE CONTENT OF THE SERVICES IS NOT AND SHOULD NOT BE CONSIDERED THERAPY, MEDICAL ADVICE, OR A SUBSTITUTE FOR INDIVIDUAL MEDICAL OR THERAPEUTIC ADVICE, DIAGNOSIS, OR TREATMENT. DO NOT DISREGARD, AVOID, OR DELAY IN OBTAINING MEDICAL OR THERAPEUTIC ADVICE FROM A QUALIFIED PROVIDER BECAUSE OF SOMETHING YOU MAY HAVE READ OR EXPERIENCED THROUGH THE SERVICES.
THE USE OF ANY INFORMATION PROVIDED THROUGH THE SERVICES IS SOLELY AT YOUR OWN RISK. NOTHING STATED OR POSTED BY EMPATHI OR AVAILABLE THROUGH ANY SERVICES IS INTENDED TO BE, AND MUST NOT BE TAKEN TO BE, THE PRACTICE OF MEDICINE, PSYCHOTHERAPY, OR THE PROVISION OF MEDICAL CARE.
5. The Role of AI
Figlet is powered by artificial intelligence. While Figlet's clinical framework was designed by Figs O'Sullivan, LMFT, based on 17 years of Emotionally Focused Therapy (EFT) practice and data from 58,000+ relationship assessments, the AI may occasionally produce responses that are inaccurate, incomplete, or not applicable to your specific situation.
Figlet is designed to help you develop empathy for yourself and your partner. Figlet does not tell you what to do. Figlet does not advise you to take specific actions in your relationship. You should not rely on Figlet's responses as professional advice. You are responsible for your own decisions and actions in your relationship.
Figlet is not a crisis service. Figlet uses natural language processing to detect potentially concerning language during a conversation. When it does, Figlet will pause the coaching conversation and offer information about external resources for further help. However, Figlet cannot guarantee that it will detect all concerning language, and this feature should not be relied upon as a safety mechanism.
6. Safety and Empathy, Not Advice
Figlet helps you understand your relationship patterns and develop empathy. Figlet does not advise you to take action, confront your partner, make demands, or change your behavior in any specific way. If at any point engaging with Figlet about your relationship causes you emotional distress that you are unable to manage on your own, stop using Figlet and reach out to a licensed mental health professional.
If having empathy for your partner or discussing your relationship puts you at risk of emotional or physical harm, do not use Figlet. Your safety comes first, always.
Figlet is not a mandated reporter and is under no obligation to report any known or suspected instances of child, dependent adult, or elder abuse. If you suspect, have experienced, or have knowledge of child or dependent adult or elder abuse, please contact your local protective services agency.
7. Privacy and Data
Empathi takes the privacy of its users seriously. For the current Empathi Privacy Policy, please see empathi.com/privacy-policy.
Your quiz responses, Wisdom Score data, and conversations with Figlet are stored to provide you with a personalized coaching experience. We use the Anthropic Claude API to power Figlet's AI responses. Your conversation data is sent to Anthropic for processing. Anthropic's data usage policies apply to that processing.
We do not sell your personal data to third parties. We do not use your conversations for advertising purposes.
Figlet is not a covered entity under HIPAA. Your conversations with Figlet do not have therapist-client privilege, doctor-patient confidentiality, or any other legal confidentiality protection. If you need confidential mental health support, please work with a licensed therapist.
Data Encryption. Your conversations with Figlet are encrypted at rest using AES-256 encryption. Even in the event of unauthorized database access, your conversation content cannot be read without the encryption key, which is stored separately from the database.
Data Retention. Conversation data is automatically deleted after 12 months. Quiz responses and your Relationship Wisdom Score are retained for as long as your account is active.
Delete Your Data. You can delete your account and all associated data (quiz responses, conversations, Wisdom Score, and profile information) at any time from your dashboard settings. Deletion is permanent and cannot be undone.
Export Your Data. You can request a copy of your data at any time from your dashboard settings. This includes your quiz responses, conversation history, and Wisdom Score results.
Age Requirement. You must be at least 18 years of age to use Figlet. By using the Services, you confirm that you are 18 or older. We do not knowingly collect information from anyone under 18. If we learn that a user is under 18, we will delete their data and terminate their account.
8. Your Account
You promise to provide us with accurate, complete, and updated information about yourself. You will not share your account or password with anyone, and you must protect the security of your account. You are solely responsible for any activity associated with your account.
9. Subscription and Payment
Figlet offers free features (Discovery Quiz, Creature Attachment Report, Self-Discovery Report, Partner Invite, the shared Relationship System Report once both linked partners complete the quiz, and an allowance of free 1-on-1 coaching messages with Figlet) and paid features (Relationship Wisdom Score, Disconnection Debrief, Figlet in Your Pocket, Repair Together (currently in beta; sessions require both partners to each hold an active subscription, or one Couple plan subscription covering both partners), ongoing 1-on-1 coaching beyond the free allowance). Paid features require an active subscription. Two subscription tiers are available: Figlet in Your Back Pocket at $19.95/month or $149/year (40 messages per cycle, with unused messages rolling over up to a 500 message cap), and Figlet in Your Hand at $57/month or $297/year (250 messages per cycle). Top-up message packs are available to subscribers on either tier. All subscription credits, rollover credits, and top-up packs are non-refundable; cancelling stops future charges but does not refund credits already on your account. Bitcoin payment is also available via Zaprite for the annual Figlet in Your Hand option.
Subscriptions renew automatically. You may cancel at any time by emailing figs@empathi.com. Refunds are handled on a case-by-case basis.
10. Intellectual Property
The materials displayed or available through the Services, including text, graphics, data, articles, images, illustrations, and other content (the "Content") are protected by copyright and other intellectual property laws. You agree to abide by all copyright notices, trademark rules, and restrictions contained in any Content you access through the Services. You will not use, copy, reproduce, modify, publish, transmit, distribute, perform, display, license, sell, or otherwise exploit the Content.
You understand that Empathi owns the Services. You will not modify, publish, transmit, participate in the transfer or sale of, reproduce, or create derivative works based on any of the Services.
11. User Content
Anything you post, upload, share, store, or otherwise provide through the Services is your "User Content." You grant Empathi a license to translate, modify (for technical purposes), reproduce, and otherwise use your User Content solely to enable us to operate and improve the Services. This is a license only; your ownership of your User Content is not affected.
You agree that this license is royalty-free, perpetual, sublicensable, irrevocable, and worldwide; provided that when you delete your account, we will stop displaying your User Content, but you understand that some User Content may not be completely removed and copies may continue to exist in our records.
12. Responsibility and Assumption of Risk
Any information or content provided through the Services is for informational and educational purposes and is not a substitute for the professional judgment and advice of healthcare professionals. The Content and the Services are not intended to be used for medical diagnosis or treatment. Persons accessing this information assume full responsibility for the use of the information.
We cannot control and have no duty to take any action regarding how you may interpret and use the Content or what actions you may take as a result of having been exposed to the Content, and you hereby release us from all liability for you having acquired or not acquired Content through the Services.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMPATHI, FIGS O'SULLIVAN, AND ALL PERSONS AND ENTITIES ASSOCIATED WITH FIGLET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES RELATED TO RELATIONSHIP OUTCOMES, EMOTIONAL DISTRESS, OR DECISIONS MADE BASED ON THE SERVICES' RESPONSES.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INFORMATION PROVIDED WILL BE ACCURATE OR COMPLETE.
YOUR USE OF THE SERVICES AND THE CONTENT IS SOLELY AT YOUR OWN RISK. EMPATHI IS NOT RESPONSIBLE OR LIABLE FOR ANY CLAIM, LOSS, OR DAMAGE ARISING FROM THE USE OF THE INFORMATION OR SERVICES.
14. Dispute Resolution
Any disputes arising from your use of the Services shall be governed by the laws of the State of California without regard to conflict of law provisions. You agree to resolve any disputes through binding, individual arbitration administered by JAMS in San Francisco, California, rather than in court, except where prohibited by law. You waive your right to a jury trial and to participate in any class action or representative proceeding.
Either party may bring claims in small claims court if eligible.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Services. Continued use of Figlet after changes are posted constitutes acceptance of the updated terms.
